Moral psychology studies the features of cognition, judgement, perception and emotion that make human beings capable of moral action. Perspectives from feminist and race theory immensely enrich moral psychology. Writers who take these perspectives ask questions about mind, feeling, and action in contexts of social difference and unequal power and opportunity. These essays by a distinguished international cast of philosophers explore moral psychology as it connects to social life, scientific studies, and literature.

When a physician employment relationship terminates, the physician–patient relationship may also be terminated by enforcement of a covenant not to compete, which typically forces the physician to leave the geographic area for a period of time. This gives rise to several ethical dilemmas. The public interest is compromised when enforcement of these covenants contributes to the shortage of physicians in the community, and individual patients are harmed when their physicians are no longer available. The authors undertook a unique study to (...) explore physician perspectives concerning the ethics of banning a physician from practice and the impact of the ban on both the physician and the physician’s patients. The results identified harmful effects that have not been raised in prior scholarly articles or reported court opinions. After reviewing the legal background of covenants not to compete, this paper presents the results of that study and concludes that resorting to the legal system for enforcement of covenants not to compete is not always the ethical course of action. While it is acknowledged that there is a need for more qualitative research on suicide, it is also clear that the ethics of undertaking such research need to be addressed. This article uses the case study of the authors’ experience of gaining ethics approval for a research project that asks people what it is like to feel suicidal to (a) analyse the limits of confidentiality and anonymity and (b) consider the ways in which the process of ethics review can shape (...) and constrain suicide research. This leads to a discussion of the ways in which ethics committees assess and monitor qualitative research more generally and some preliminary suggestions for how this might be improved. (shrink)

. On June 13, 2013, the Supreme Court issued a unanimous decision in Association for Molecular Pathology v. Myriad Genetics, holding that a naturally occurring DNA segment that has merely been “isolated” is not patent eligible, and effectively overturning a longstanding policy that had allowed for patents to be issued on thousands of human genes. Drawing largely on the expert testimony and arguments presented during the court proceedings, this paper provides an overview of the discovery and patenting of the BRCA1 (...) and BRCA2 genes at issue in the case, the impacts of gene patents on biomedical research and innovation and clinical practice, and the legal analysis presented by the plaintiffs throughout the case for how patents issued on genes violate the Patent Act and the U.S. Constitution. Finally, it discusses how the Court’s decision in this case marked an extraordinary victory not only for the plaintiffs directly involved, but more generally for women, patients, researchers, civil liberties, and the future of medicine. As employee assistance programs (EAPs) have evolved and expanded their scope in the past decade, many factors have contributed to meeting the demands of conflicting client constituencies in a multifaceted client environment. This article enumerates several of these factors, notes consequences of ensuing conflicts, and ultimately proposes some methods to counter some of these ethical dilemmas in the future. It is the hope that greater recognition and understanding of ethical conflicts in client loyalty within a host organization will foster increased (...) sensitivity on the part of the EAP practitioner toward resolving these conflicts. Background: Recent changes to regulatory guidance in the US and Europe have complicated oversight of secondary research by rendering most uses of de-identified data exempt from human subjects oversight. To identify the implications of such guidelines for harms to participants and communities, this paper explores the secondary uses of one de-identified DNA sample collection with limited oversight: the Human Genome Diversity Project (HGDP)-Centre d'Etude du Polymorphisme Humain, Fondation Jean Dausset (CEPH) Human Genome Diversity Panel. Methods: Using a combination of keyword (...) and cited reference search, we identified English-language scientific articles published between 2002 and 2009 that reported analysis of HGDP Diversity Panel samples and/or data. We then reviewed each article to identify the specific research use to which the samples and/or data was applied. Secondary uses were categorized according to the type and kind of research supported by the collection. Results: A wide variety of secondary uses were identified from 148 peer-reviewed articles. While the vast majority of these uses were consistent with the original intent of the collection, a minority of published reports described research whose primary findings could be regarded as controversial, objectionable, or potentially stigmatizing in their interpretation. Conclusions: We conclude that potential risks to participants and communities cannot be wholly eliminated by anonymization of individual data and suggest that explicit review of proposed secondary uses, by a Data Access Committee or similar internal oversight body with suitable stakeholder representation, should be a required component of the trustworthy governance of any repository of data or specimens. Human-eyelid conditioning was the principal source of information on Pavlovian conditioning, especially human, in the 1950s and 1960s, but it suffered a sharp decline in productivity, beginning in the late 1960s. The present article treats the decline as a case study with potential implications concerning the survival contingencies of research specialties. We make use of questionnaire data from eyelid-conditioning researchers and examine a variety of publication, topic-of-investigation, and institutional data to identify the major factors in the decline of human-eyelid conditioning.

ArgumentIn recent decades, through the work of Jane Goodall and other ethologists, the practice of giving personal names to nonhuman animals who are the subjects of scientific research has become associated with claims about animal personhood and scientific objectivity. While critics argue that such naming practices predispose the researcher toward anthropomorphism, supporters suggest that it sensitizes the researcher to individual differences and social relations. Both critics and supporters agree that naming tends to be associated with the recognition of individual animal (...) rights. The history of the naming of research animals since the late nineteenth century shows, however, that the practice has served a variety of purposes, most of which have raised few ethical or epistemological concerns. Names have been used to identify research animals who play dual roles as pets, workers, or patients, to enhance their market value, and to facilitate their identification in the field. The multifaceted history of naming suggests both that the use of personal names by Goodall and others is less of a radical break with previous practices than it might first appear to be and that the use of personal names to recognize the individuality, sentience, or rights of nonhuman animals faces inherent limits and contradictions. In African society today, ubuntu as a notion of African humanism has been, and still is, subject to critical discussion. In African literature, philosophy, ethics, anthropology and theology, ubuntu plays a vast role and scholars in Africa and globally find the notion highly debated. The concept of identity development on the African continent has been written about broadly. This article unpacks the ubuntu philosophies of Augustine Shutte, Kwame Gyekye and John Mbiti. The views of these scholars will be contrasted to (...) critically engage the conceivable commonalities for identity development through cultures. The question addressed herein is: What are the similarities and dissimilarities of ubuntu as a cornerstone for identity development in modern Africa? This article also examines the divergent definition and historical development of ubuntu culture, ubuntu philosophy of identity development, environmental development and various thinkers’ understanding of this African worldview in current Africa and further afield. Contribution: This research contributes to African theological ethics of the new landscape identity and explores the ubuntu worldviews as a developmental process of identities across cultures. Since identity development across cultures is highly dynamic, the hermeneutical interpretation of the principles of ubuntu is crucial. (shrink)

Moral case deliberation (MCD) is a specific form of clinical ethics, aiming to stimulate ethical reflection in daily practice in order to improve the quality of care. This article focuses on the implementation of MCD in nursing homes and the questions how and where to organize MCD. The purpose of this study was to evaluate one way of organizing MCD in two Dutch nursing homes. In both of these nursing homes the MCD groups had a heterogeneous composition and were organized (...) apart from existing institutional communication structures. As part of a naturalistic evaluation, systematic observations, interviews and focus groups were completed. The findings indicate that the heterogeneous composition and MCD meetings separate from existing structures have benefits. However, the participants also reported negative experiences. This gives rise to the question whether a mixed MCD group which meets separately is an effective way to embed MCD as an instrument for reflection on moral issues in daily practice. We conclude that there is no single answer to that question. In the end, the two implementation strategies (i.e. within existing communication structures and a mixed MCD group) can be complementary to each other. (shrink)

The complexity of biobank research raises concerns about individuals’ understanding of the information conveyed in the consent process for such research.. We report the results of a qualitative, cognitive interview study with an ethnically, linguistically, and educationally diverse sample of 43 respondents to assess the clarity and utility of a multimedia tool developed for a biobank. Using weighted randomization, respondents were assigned to either view the multimedia tool or read a written consent document . The study illustrates the utility of (...) cognitive interviews for gaining insights from prospective research participants about the clarity of informed consent tools. Findings suggest that a multimedia tool is useful for communicating key messages but should be combined with a written consent document and personal interaction with the study staff. We recommend that the potential value of multimedia tools should be more rigorously tested in a randomized controlled trial. (shrink)

Partly as a result of much recent evidence of business and government crime, a large proportion of major corporations have adopted codes of ethics; government service is also making more use of them. The electrical manufacturing anti-trust conspiracy and 1973–1976 investigation of foreign and domestic bribery were immediate prods. There are also government codes of which the ASPA code is most widely distributed. Corporate codes discuss relations to employees, interemployee relationships, whistle blowing, effect on environment, commercial bribery, insider information, other (...) conflicts of interest, anti-trust, accounting, consumer relations, and political activities. A discussion of use of codes shows partly favorable results. A number of corporation decisions have not yet become a subject of code provisions. Codes will be more useful if the reasons behind each order are stated and team work is encouraged. (shrink)

Examining how new forms of currencies diffuse is important to uncover their impact on the organization of communities, and thus motivates our study of community currencies. Community currencies provide a medium of exchange by using alternative banknotes or electronic money, which circulates only within particular communities, allowing members to trade goods, increase social cohesion, and achieve collective goals. In this study, we examine how community currencies help facilitate social commons by serving as a setting for building community relationships and a (...) catalyst for other social activities beyond market relations. We analyze cases of community banks that provide microfinance and issue community currencies in Brazil. We find that microfinance entrepreneurs who involve a greater diversity of stakeholders from public, private, and nonprofit sectors in decision making even prior to startup, while also facilitating the formation of supportive social capital from diverse cross-sector stakeholders, increase opportunities for developing new community currencies. By exploring the implications of entrepreneurial actions that promote inclusive participation of diverse stakeholders for accomplishing collective goals, our findings are relevant for other activities that create a common pool of resources while also developing the vitality of the community, including initiatives that use cryptocurrencies and other emerging forms of currencies for building social commons. The precise nature of W. S. Jevons's utilitarianism as a guiding rule for economic policy has yet to be investigated, and that will be the first issue treated in this paper. While J. A. Schumpeter, for instance, asserted that ‘some of the most prominent exponents of marginal utility’, were ‘convinced utilitarians’, he did not investigate the further implications for Jevons's policy analysis.

The technology for the digitized text creates fluid meaning, representing its culture in transition from the dominance of the single-authored text with its hierarchically ordered system. This new architecture for the digitized word has been making explicit the shift from human consciousness reflecting the interiority of the self to a human consciousness reflecting self in relation to others. Educators using the technology of networked writing environments need to understand how the technology functions and intervenes for pedagogical processes during models of (...) asynchronous and synchronous collaborative writing. Both models support a constructivist view of learning; however, for each, educators need to consider the ethos of the writer as inhabiting a negotiated, shared space with readers during text production. As a consequence, cocognition may occur when writers share ideas and engage in the process of collaboration. (shrink)

Hugh H. Benson explores Plato's answer to Clitophon's challenge, the question of how one can acquire the knowledge Socrates argues is essential to human flourishing-knowledge we all seem to lack. Plato suggests two methods by which this knowledge may be gained: the first is learning from those who already have the knowledge one seeks, and the second is discovering the knowledge one seeks on one's own. The book begins with a brief look at some of the Socratic dialogues where (...) Plato appears to recommend the former approach while simultaneously indicating various difficulties in pursuing it. The remainder of the book focuses on Plato's recommendation in some of his most important and central dialogues-the Meno, Phaedo, and Republic-for carrying out the second approach: de novo inquiry. The book turns first to the famous paradox concerning the possibility of such an inquiry and explores Plato's apparent solution. Having defended the possibility of de novo inquiry as a response to Clitophon's challenge, Plato explains the method or procedure by which such inquiry is to be carried out. The book defends the controversial thesis that the method of hypothesis, as described and practiced in the Meno, Phaedo, and Republic, is, when practiced correctly, Plato's recommended method of acquiring on one's own the essential knowledge we lack. The method of hypothesis when practiced correctly is, then, Platonic dialectic, and this is Plato's response to Clitophon's challenge. (shrink)

A general conceptualization of God’s omnipotence is that he possesses illimitable superior power over and above every other thing. Consequently, God is thought of being able to bring about “all” things. Such belief includes that as all-powerful, he does not need to be protected or defended by his creatures, insofar as he “cannot” be vulnerable to the threats or attacks of any creature, except possibly self-inflicted attacks, which would be selfcontradictory. Human power, on the other hand, assumes the belief that (...) even though God is absolutely omnipotent, believers in him have the duty to either carry out what they believe is his commandment or each one acts as he should act. This being so, the human claim to omnipotence absolutizes man/woman as being able, with impunity, in fact, with stupendous promise of reward, by acting as the “arm” or “brain” of God. The logical conclusion of such reasoning is to deny either claim of omnipotence by God or man. But how plausible would such a conclusion be to real-life situation? (shrink)
